Questions for Judge Morey and Judge Hill regarding Derek Walker.

Judge James Hill, Judge Marcia Morey and Durham County NC Special Interest Groups

NC Fathers is asking Judge James Hill and Judge Marcia Morey to put to rest some concerns our organization has regarding special interest groups that do benefit from unequal family courts. First, we ask that Judge Morey, Judge Hill, and our readers turn their attention to the Social Security Act Title IV Part D and pay special attention to Section 458 entitled “INCENTIVE PAYMENTS TO STATES”. Pursuant to this section of tge linked Legislation, the State of NC Social Services agencies gets back $2 for EVERY $1 dollar collected in child support. This means that for every non-custodial father paying $400 a month in child support, he is making $800 available to social services to be used for low income assistance programs. We are asking Judge Marcia Morey and Judge James Hill if they think this opens the door for bias and abuse at social services with respect to them working with fathers and men, but dealing lightly with women? Additionally, does this revenue generation have anything to do with low visitation judgements in the Durham County NC Courts so that social services funding can be maximized thru increased child support payments? For our readers, how do you feel knowing that your child support payments are replenishing money for low income assistance programs on the back of you not being able to get equal visitation time or custody of your children? Perhaps Judge Marcia Morey and Judge James Hill will address this as well.

Judge Morey and Judge Hill, with regards to this software company, we ask both Judges how much they think this software will cost the State of NC to develop, install, implement, and train child support agencies across NC to use? We suspect several million dollars if not more. Since PSI is a government agency who wants Title IV-D money to bring this software alive, Durham County NC non-custodial families will be paying for this via child support, or INCREASED child support. WHY are non-custodial families putting food on the plates of software developers on the back of these paternal grandmothers, step-mothers, fathers, and paternal aunts not being allowed to have equal access and parentage of their children?

Both Judge Marcia Morey and Judge James Hill should be aware of the phrase “The only people who win in Family Courts are Lawyers”. And, indeed this seems true given that because the Durham County Courts are SO divisive (see below), it is assured that two parents will fight for 18 years and until bankruptcy, thus allowing lawyers who charge $5000 retainers per incident to become a special interest group who makes money off the dichotomy of the Durham County Courts. NC Fathers view on this is that if the courts were equal, and Judges discouraged the fighting, parents could save $5000 retainers every few years and put that money towards the children. Judge Morey, will you address this? Judge Hill?

Given the data above, surely Judge Marcia Morey and Judge James Hill sees that there are several agencies and special interest groups who make money off the divisive family courts which always ends badly for the non-custodial family/minor child relationship. Why is this happening Judges?

NC Fathers believes that Durham County children garner more opportunities and resources when they have two equal parents AND extended family support than any enforcement agency, software company, or rich lawyer can ever bring these children. Judge Hill, why are we not putting all this money for special interest groups into a program like equal shared parenting? Judge Morey?

Does Judge James Hill and Judge Marcia Morey of the Durham County District Courts recognize these divisive issues that exists in the NC Family Courts for Durham County non-custodial families?

  • Surely Judge Morey is aware of the “absent father” issues that so many Judges and professionals are talking about. Does only giving non-custodial fathers and families 4-5 days a month visitation help with that absenteeism? Judge Hill?
  • Surely Judge Hill is aware of the “absent father” issues so many Judges and professionals are talking about. Does allowing custodial mothers to move children away from Durham County non-custodial fathers and families contribute to this absenteeism? Judge Morey?
  • Are either Judges sure that the Family Courts are not contributing to absent fathers?
  • Judge Marcia Morey is surely aware that the Durham County NC Courts have no presumption for who gets custody of children. However, the AOC tells us that 85% of mothers get custody. Given this high number, it sure seems like presumption to NC Fathers. Judge, if 85% of women were not allowed to work in corporate environments, would this be a problem?
  • Surely Judge James Hill recognizes that when custodial mothers have financial problems, there are ample assistance programs available to her to help make these ends meet. These include medical, financial, housing, educational, and earned income credits. However Judge, when non-custodial fathers get into trouble, their mothers/wife/aunt has to visit them in the Durham County Jail. Why?
  • Why do custodial mothers get FREE child support enforcement attorneys in child support cases while Durham County non-custodial fathers and families have to secure $5000 retainers every time this powerful federal agency wants to review support?
  • Judges, are non-custodial fathers akin to international drug smugglers and terrorist? Surely Judge Morey recognizes that terrorist and drug smugglers get the attention of federal enforcement agencies (DEA and FBI). So why are fathers introduced to the federal office of child support enforcement agency just because we are not ALLOWED equal access and parentage of our children?

Perhaps Judge Marcia Morey and Judge James Hill do not see these issues as problems, but we are asking Durham County NC non-custodial families if they see this as a problem?

Does Judge Marcia Morey and Judge James Hill of the Durham County NC District Courts realize that given the divorce rate, that non-custodial fathers, paternal grandmothers, step-mothers, and other family members and friends who EQUALLY hurt in the divisive family courts that are setup for special interest groups realize that these families represent 4.5 million voters? Does either Judge recognize that non-custodial families are represented by African American fathers and women of paternity? Or, that we come from Hispanic and Asian families? Does this not make these non-custodial families a significant and overwhelming swing vote?

NC Fathers has a GOAL to get ALL of these 4.3 million voters on our mailing list so that we can start affecting local, state, and federal elections that will surely force legislators to reform the Family Courts and Social Services to be less about funding, politics, and special interest groups that benefit while we are marginalized as visitor families who only deserve 4 days a month visitation.

  1. All I can say…Is how could they intelligently respond to these issues/questions if they do not even “follow” our Constitution or should I say…”our Constitutional Rights as parents”?? I think they understand “cliques” and personal biases!! I know personally of their destruction–Pat Evans is a great asset to Family Court and actually cares what is in the child’s best interest–Durham, NC

I have a five year old daughter that’s my world , her mom is in a relationship with a convicted sexual afender that had sexual incounters with his previous step children one five boy and four year old girl served time for it was on regestry for ten years now off before he got off mr hill told my wife not to have him around our daughter she did anyway numerous time I hired a pi and got the prof he awarded me full custody to deferent times this time and one time when she didn’t show for court , just went back and mr hill let me down terribly by giving her back her 50/50 and saying she learned her lesson by having her child takin from her but that doesn’t bother me so much it’s that she said her and boyfriend where living together now and going to get married and had a child on the way so hill said since he did his time and all that he wasn’t a threat anymore and aloud him to be around our daughter overnights and all an he can’t even be around his own child overnights.he has made a terrible decition and I have spent all my money on attorney fees and all that I’ve been thro . The Lord has givin me our precious daughter to look after and do my very best for and that’s what I intend to do . To whom this my concern please help me if you can ,I’m in fear for my daughters safety and well being, and the system has let me down

    • Jason join us on Facebook and find each and every single non-custodial father you can find and get them involved too. As we get stronger Judges like Marcia Morey can feel the heat at election time.
