Representative Larry HallOn September 19, 2012 at 4:00PM, NC Fathers emailed Democrat Representative Larry Hall of Durham County NC and asked him where he stands on equally shared parenting. By equally shared parenting we mean defining new legislation that adopts equal parentage and access to children by both parents starting out, having them follow a parenting plan, then deal with problem parents who refuse. The thinking here is that by rewarding parents in doing this, children could start enjoying the opportunities and resources of both parents and extended families instead of the default marginalization of one parent (and extended family) as visitors who pay a government agency for access to their children. In all fairness, emailing Democrat Representative Larry Hall and other members of the NC General Assembly about bringing equally shared parenting to the  Durham County NC Courts was futile, as we already know what his answer will be when we started to write this article. Which is fine, because this article on the distinguished representative from Durham County is for non-custodial fathers, step-mothers, paternal grandmothers, and paternal aunts and uncles who we imagine are tired of being treated like second class citizens by the NC Family Courts, Lawyers, Social Services Agencies, and the NC General Assembly. In this article, we are going to explore many of the issues that contribute to the alienation of non-custodial families and children in the hopes of building a massive non-custodial family lobby that starts holding Representatives, Judges, and others accountable at election time unless they stop the purposeful parental warfare for profit that exists now. Could Representative Larry Hall have prevented the Derek Walker Shooting?

So I bet you are dying to know HOW we already know what Rep Hall will say to us about equally shared parenting huh? Well, hopefully you read the link above pointing to Durham County DSS, and here we have some information about NC Lawyers which is Rep Hall’s trained profession. Now keep in mind, NC Fathers has NO problem with Welfare and Low Income Assistance, or it’s funding. But we are very adamant that it should not be done OFF another group of people, especially people who are unable to get equal parentage and access to their children. I guess now is a good time to ask Representative Larry Hall if it is the NC Judiciary’s plan to deny equal parentage, access, and give limited visitation to Durham County NC Non-Custodial parents so that their child support is increased, thereby triggering greater funding for social services? No? Well, we do, and it’s a pretty sick idea to keep parents, grandmothers, step-mothers, and aunts away from their children to fund government.

Here is the bottom line. Due to the Social Security Act, Title IV-D Legislation allows for the State of NC to get federal match money for every dollar they collect in child support. This means that every Durham County NC African-American Father denied 50/50 physical custody of his son/daughter and ordered to pay $500 a month in child support, he is triggering about $400 in federal funding for social services. It is this setup which is keeping African-American and Hispanic grandmothers, step-moms, and aunts on their knees wondering why they aren’t allowed to see their grandchildren/step-children/and nieces/nephews as much as custodial parents. Representative Hall, I hope you weren’t about to make this a female vs. male issue, because we just ruined that.

OK, enough of the anger laden sarcasm surrounding this article, but we find it particularly disgusting that Representative Larry Hall does not agree that Durham County NC non-custodial families should have equal parentage and access to their children, and that there should exists a major division between parents. First and foremost, we cannot forget that the distinguished Representative is an attorney who no doubt has many friends who practice family law. And no doubt Rep Hall understands that parents are willing to fight for 18 years, and go bankrupt doing it. Is it the $7000 dollar retainers that these parents pay every 6 months fighting and fighting that is driving the NC Bar Association to not support equal parenting? What about your decision making at the NC Legislature?

The second issue, and probably the one that burns us up the most is that Rep Hall and the Durham County Democratic Party knows that in NC there is NO presumption for which parent gets custody of a child, but the AOC is very open about the fact that 85% of women get custody in NC. AND, of the 15% that lose custody, 7% will regain custody once they get some services to correct issues that caused them to lose custody in the first place.  85%-%92 is a HUGE number in a State with NO PRESUMPTION. As an African-American, who’s party Represents women, we are floored that Representative Hall does not recognize discrimination and bias when it’s standing in front of him. That, or he does recognize it and chooses not to address it because it does not fit in with his party’s ideology. Either way, in 2012, if %85 of African-American men were not ALLOWED to vote, or 85% of women not allowed to vote, we suspect that Representative Hall and the Democratic Party would be outraged. But not when it affects others huh?

Someone should explain to Representative Larry Hall and the Durham County Democrats that the issues we are speaking about in this article affects a LOT of Democrats. African-American men are the most targeted group of Fathers by Child Support Enforcement. Hispanic step-moms are important to NC kids. There are a lot of African-American paternal aunts who would cherish the idea of being able to help raise their nieces and nephews. In fact, it makes a hell of a lot of sense that Durham County children receive more opportunities and resources when they have two equal parents, and the love, support, and care brought by two extended families that a big government agency will never be able to bring. In fact, research shows that non-custodial parents spend more money on their children when they have them equal time compared to their child support obligations. But I guess this does not fit in with the political football surrounding these issues, and the Title IV-D federal funding you enjoy so much huh Representative Hall?

Update: June 1, 2013 – After repeated attempts to contact Representative Larry Hall regarding shared parenting in North Carolina and having him blow us off, it should be noted to Durham County non-custodial parents, step-mothers, grandmothers, and other family members who have an interest in equal parentage and access to their young loved ones that this Representative does not share your concerns.

  1. I hope your organization is not expecting anything on these issues from Representative Hall as he is very much a “tow the party line” regardless of right and wrong. Larry Hall would stand in the Legislature all day and fight the Democrat side if they wanted to declare that the world is flat!

    • Jim, when we created this article, we never envisioned Representative Larry Hall thinking along our lines. As stated in the blog, this article exists for his constituents that are in Durham County non-custodial families.

  3. As a Durham County NC Democrat I would be happy to tell Representative Larry Hall about how bad the family courts are in Durham County. My Son has fought for years just to try and get weekends with his daughter and has gone broke in doing so. These legislators want to talk about how bad African-American Fathers are and then these Judges go and prevent them from being a Father? Someone better check their values and morals Representative!

  4. Rep Hall is going to tow the Democratic Party line which is all about Women Voters. I hope your organization can show him that there are many Women in all cultures in paternal families who this issue is affecting. I’m damn tired of hearing about equality by Democrats because there sure isn’t any for Fathers in the courts.

  5. My son is in the same boat. Child Support is all about wanting him to pay child support but the mother denies visitation. It’s a shame the government will go after that money put nobody there to help secure visitation rights when the mother hides behind her free lawyers knowing that we don’t have the money to hire a lawyer. The good Representative needs to fix this and thank you for this organization.

I’m a Father who has experienced just about everything in this article and it is long overdue that Fathers and their families united around an organization. I just shared this on Facebook and hope that many of my friends will join NC Fathers.

  7. I talked with Larry Hall and other Representatives about a similar problem I had with the Durham County courts years ago and got blown off. Hopefully if this organization builds a big enough base he will listen this time.

  8. Representative Hall, how many African-American and Hispanic families is this issue affecting? How many Women in these families are these issues hitting home with? Where is the party of equality? I hope more Durham County NC non-custodial families get involved with this organization.
