NC Fathers Rights

Republican Rep Pat McElraft – Carteret and Jones County

Pat McElraftRepublican Representative Pat McElraft represents Carteret and Jones County NC and we are a group of NC Fathers, paternal grandmothers, and other extended female family members of fathers who are reaching out to Representative McElraft in an effort to have or voices heard on the NC Family Courts and NC Child Support Enforcement System.

Judge, courts, nc

First and foremost, we want Representative McElraft to understand that the NC Family Courts are ripe for parental fighting that lasts for decades. Anytime you have one group of people winning 85% of the time (custodial mothers) and another group losing 85% of the time (non-custodial fathers) you are going to have anger, resentment, and discord that only hurts NC’s children. Children love both of their parents and do not acknowledge a greater love for one parent. Also, more and more studies are showing that children with absent parents have a greater suicide rate and emotional disturbances. We do want Rep McElraft to understand that there are a lot of fathers who choose not to be a part of their children’s lives, but I bet you would be surprised at the number of “deadbeat fathers” who WANT to be a part of their kids lives but can’t because the courts allowed a mother to move the kids half way across the country or they went bankrupt fighting multiple battles in court only to lose.

Roughly half of custodial mothers today have male children who will one day be pushed to the margins of their kids lives if they experience a divorce and have children. Where do you think these non-custodial grandmothers (who will also be marginalized as well) will stand then Representative McElraft? With Equally Shared Parenting?

What about woman in paternal families Representative McElraft? Do you not think they get hurt in this system as well?

Representative Pat McElraft

We realize that Representative McElraft is all to aware of fathers in NC who are being jailed for failure to pay child support. However, the courts do not acknowledge that many times it is not a conscious failure to not pay child support, it may be that there is an inability to pay child support. Furthermore, we find it insulting that fathers are jailed for not paying child support while custodial mothers are given federal and state assistance in the form of housing assistance, medical assistance, and tax credits in order to make ends meet financially.
Republican Representative Pat McElraft and Carteret and Jones County non-custodial families
Representative Pat McElraft represents a lot of fathers and numerous females of paternity in the NC General Assembly, so we wonder what she has to say to this group of folks that are not seeing their young loved ones equally, who are watching custodial mothers and her extended family enjoying raising children 26 days a month, and who are getting assistance to make ends meet while fathers are jailed.

Is Republican Representative Pat McElraft aware that the State of NC makes money from the federal government in collecting child support in Carteret and Jones County?

On August 3rd, 2013 the Carteret County News Times announced that Representative Pat McElraft is urging massive turnout for a critical habitat hearing. Meanwhile, the Republican Representative has not lifted a finger to end the practice of a hopeful custodial parent alienating a child across State lines hoping that the non-custodial family can’t get $15,000 together to ever see the child again. Representative McElraft refuses to do anything about parents spending $80,000+ dollars in a court system that clearly benefits others financially when parents fight for 18 years. How is this good for children Pat?

To us this is the most disturbing part of the NC Child Support Enforcement System. There are no less than three federal legislative pieces that give incentive payments to the State of NC for increased collection of child support, and the only way to get increased child support collection is via decreasing time spent with non-custodial families. As more and more fathers and female members of paternity learn that quite possibly the reason they are not seeing their young children as much as mothers and her extended family is due to the fact that NC makes money off collection of child support, I don’t think Carteret and Jones County families will be very happy with Representative McElraft. We also wonder if this system was built as an incentive to keep a divisive court system since as long as mom and dad are fighting someone has to lose so the State can make money.

If you are a NC, or Carteret and Jones County Father or female extended family member of a father who is not seeing his children equally then we ask you to contact Representative McElraft today and let her know of your frustration and demand that presumption of shared parenting become law in NC so that kids can have both of their parents and extended family equally. With this in mind we ask that you share this article on Representative Pat McElraft with other families in Carteret and Jones County on sites like Facebook and Twitter so that we can build a massive organization of non-custodial families voters who can start talking with Representatives daily.

Often, we hear legislators and judges tell us that the NC family courts, like the ones in Carteret and Jones County are about the best interest of a child and nothing else matters. This narrative is a lie. Consider the following example. When two parents separate, one parent can legally leave the family home and prevent a child from seeing the other parent until there is a court order. It cost the alienating parent $0 to do this, but costs the other parent upwards of $15,000 to remedy the situation in the courts. If the alienated parent does not have $15,000 then he/she NEVER sees the child again. All because of money? Representative Pat McElraft and other Republicans are fine with one parent, grandparents, and other family members not ever seeing a child because they weren’t able to get $15,000+ in cash? Where is the best interest of the child Representative? Sounds more like best interest of a lawyer.

Additionally, using the comment system below, we ask non-custodial families to leave comments to Representative McElraft because she does need to realize that this issue affects many men and women from all racial and cultural backgrounds.

Update 2/24/2015: This Republican lawmaker does not care about Carteret County or Jones County men and women in paternal and non-custodial families. She only cares about the lawyers lobby and their special interest group friends who make money from two parents fighting for 18 years in a purposeful unfair system. Any woman or man in a paternal family who votes for Representative Pat McElraft in any future elections needs to see a psychiatrist. And, if you do don’t come crying to us when nothing changes.

  1. As a Carteret County NC non-custodial family member from a large family here in the county, I was sorry to see Representative Pat McElraft not support the 2013 House version of the Shared Parenting bill so that my son can finally have his son as an equal parent in favor of this system where the courts encourage two parents to fight for 18 yrs hurting kids and causing parents to go bankrupt. I am a woman Representative, I hurt in this process too!

    • Actually, I think that Representative Pat McElraft is a sponsor of the House Bill in 2013 that talked about Shared Parenting but I think it is stuck in committee. However, the Senate version is much better because it addresses discretion. I will check, maybe she is no longer a sponsor but the last time I looked she was.

  2. As a grandmother I am personally appealing to Pat McElraft to consider shared parenting so that maybe I will have a chance to see my grand daughter more often. I do not get to see her because her mother left my son and did not tell him and moved the kids away to Texas and he has no money to hire an attorney thus we fear that we will never see her again. As a grandmother I am pleasing with this Representative to help. I met Pat at a anti-bullying rally and few years ago and found her to be a very caring lady who is very concerned about children.

  4. I would hope all of the Republican leadership in Carteret County would support shared parenting because the fact is children receive much more support from BOTH parents and extended families which would take a lot of the burden off the social services system which is seemingly the go to agency for custodial parents.

  5. I live in Jones County and I am a Father who has not seen his son in over 3 years because the mother moved to Oregon after our divorce. I pleaded with the Judge that I was an active and involved father and he still let her move away. We always hear about deadbeat dads but the courts made me an absent father and I hope this Representative will help stop that.

    • Thom I feel your pain. I had Judge Peter Mack here in Carteret County and despite being a very active father both days all weekends, paying child support, attending school functions this Judge allowed my ex-wife to move away with my son. I don’t get it, legislators lament all these deadbeat dads by refuse to look at the courts creating absent parents, I can also tell you this after studying shared parenting, even if Representative McElraft brought us shared parenting unless its non discretionary the Judges will just use their discretion to bypass the law.

  6. The minute we have shared parenting in NC and parents have nothing to fight over in the courts, they will be forced to get along. Right now the courts encourage two parents to fight and win something and this is causing a lot of domestic violence and hardship for children. Please Representative McElraft, help us.

  7. I am a Jones County Step-Mom encouraging Rep McElraft to urge lawmakers to bring shared parenting. As a Woman I can tell you things are bad, there are no rules, one Judge does this, another Judge does this, they hurry through cases never hearing the whole story and they are absolutely biased against fathers.

  8. I am a Carteret County paternal grandmother who is mad as hell at Rep Pat McElraft for allowing the courts to turn my son in to a part time 4 day a month parent just because his wife decided to leave him for another man. Judge Peter Mack out to be ashamed of himself and you out to be ashamed for yourself for not addressing the family courts!

    • Jenny, the Republican lawmakwer does not care about your son or you, nor does Judge Mack. Judge Mack cares about his friends, the lawyers who make money from the family courts when two parents fight for 18 years never getting anything resolved. If the courts were fair, there would be no fighting and no rich lawyers. The Republican lawmaker has but one interest, and that is special interest. She is well aware that the lawyers and their lobby groups are a BIG time donor to the Republican party and can effect elections. The Republican lawmaker does not care how unfair this is, if your ever see your grandchild again, or if your son loses his mind in agony.

  9. I live in Jones County and went to court last week and I am astounded and angry. My wife left one day while I was at work, left no information where her and the kids were. Nothing. It tool me 6 months and several thousand dollars to find out where my kids were and another $5000 for an attorney in Memphis TN (where she ran to) only to get there and have a Judge tell me that because they have been in TN for 6 months and are established, she get’s custody and now I have to travel to TN to see my children. So now leaving a parent, hiding for 6 months, and establishing 6 months is a way to win custody. If I would have done this the courts would have FRIED me. Thanks for nothing Representative McElraft. What a great proponent of family values the Republican party has.

  10. I attempted to talk with the Representative about this issue and her staff completely blew me off and tried to get me off the phone but she is concerned about some turtle habitat? Damn turtles get more respect than a parent who isn’t allowed to see his children but 3 days a month because some Judge has been trained that mothers and children belong together and daddies should pay for it to happen?

  11. I don’t even have words for how biased the family courts are. I went to mandatory divorce mediation last week and agreed to everything while my wife refused to mediate because she wants everything and she knows that she will get it. I guess I have to look forward soon to being a weekend father while the next guy she has in the house because the identified father who gets to raise and see my children more than I do.

    • Arthur, you are correct. That is exactly your fate and nobody cares because they know you will get so angry that you will likely file a motion to TRY and reverse it which cause you to spend money with a lawyer. It won’t be reversed, and you will try again, and again, and again each time spending money with a lawyer. They also hope you get a restraining order put on you, that you violate it, so that there is more billable hours. And of course Representative McElraft and other Republican lawmakers will get a nice little present at election time from the lawyers lobby group in NC.

  12. Well I am a female voter, I live in Emerald Isle and this Republican lawmaker can kiss my a$$ because I am one pissed off grandmother after the way the courts treated my son and his parental rights. How in the hell can a father who wants to be a parent see his children moved off to Nebraska because a mother wants to be a single mom near her parents? WHAT ABOUT US PAT????????????
